TERM AND CONDITION

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THE APPLICATION AND REGISTERING AN ACCOUNT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THIS TERMS AND CONDITION (AS AMENDED FROM TIME TO TIME). THE PRIVACY POLICY WILL SUPPLEMENT AND FORM AN INTEGRAL PART OF THESE TERMS AND CONDITIONS. YOU MAY ACCEPT THE TERMS AND CONDITIONS AND THE PRIVACY POLICY BY CLICKING ‘TO ACCEPT’ OR ‘TO AGREE’ WHERE IT IS MADE AVAILABLE TO YOU IN THE USER INTERFACE OF THE APPLICATION.

A. DEFINITIONS

In this Terms and Conditions, the following capitalised terms shall have the following meanings:

B. ACCOUNT AND REGISTRATION

1. Our Bubblebee App is provided to the User on free of charge basis and only for personal use and not to be shared with other third party or user.
2. Each User must sign up or register an Account prior to using the Bubblebee App. In order to complete registration of Account, you must provide the following details:
1. mobile number and you will be provided with a one-time pin for authentication purposes;
2. full and accurate of personal details such as your full name as per your NRIC, date of birth, e-mail address and other relevant information required by Bubblebee; and
3. a string of characters as your password for you to log into the Account. You are solely responsible for maintaining the confidentiality of your account and password.
3. Only User at the age of 18 and above will be allowed to complete the registration of Account. If you are younger than 18 years of age, you confirm that you have the permission of your parent or legal guardian who has consented to this Terms and Conditions.
4. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date.
5. You may close your account at any time by requesting to do so by contacting us using the contact details set out in this Terms and Conditions.
6. Bubblebee reserve the right to terminate or suspend your Account at anytime if we believe there is unusual activity on it.

C. ORDERING

1. We offer our product in different areas. In the event that you opt “pick-up” or “dine-in” option, you shall select the accurate outlet displayed in the Platforms. You are responsible for collecting your self-pick-up order at the selected Outlet within a reasonable period of time. Bubblebee will not be responsible to retain the order for your collection after the said period has lapsed.
2. To place an order through delivery services, you shall enter your delivery address on the Platforms and you will see the list of outlet that we make available to you at each particular time.
3. To complete an order, you shall follow onscreen instructions after clicking ‘Checkout’. You may be required to provide additional details for us to complete your order. You are required to review and confirm that all the information you provide, including the amounts, delivery details, personal details, payment information, and voucher codes (if applicable) is true, accurate and complete before you click “PLACE ORDER”. An order is successfully placed when you receive an email confirmation containing your order receipt from us.
4. In the event that you wish to cancel your order, please contact us immediately via our in-app customer support chat feature if you wish to cancel your order after it has been placed. You have the right to cancel your order provided that the respective Outlet has not yet accepted your order.

D. PRICES AND PAYMENT

1. All prices quoted on the Platforms will be displayed in Malaysia currency and subject to applicable tax such as sale and service tax.
2. In the event that you opt for delivery option, there will be a delivery charges imposed on each order unless you have a valid promotional or discount voucher and apply it at Checkout or unless stated otherwise.
3. Some orders require a minimum order value (“MOV”) before an order can be placed and delivered to you. Where an applicable order fails to meet the MOV, you will have the option of paying the difference to meet the MOV or to add more Product to your order.
4. All prices and additional charges (including but not limited to delivery, Small Order or Service fees) indicated on the Platforms are as at the time of each order and may be subject to changes.
5. Bubblebee reserves the right to offer additional payment methods and/or remove existing payment methods at anytime in its sole discretion. If you choose to pay using an online payment method, the payment shall be processed by our third party payment service provider(s). With your consent, your credit card / payment information will be stored with our third party payment service provider(s) for future orders.

E. REFUND POLICY

1. You have the right to a refund for a cancelled order only if only our Outlet has not yet accepted your order. Should you still decide to cancel your order after it has been accepted by our Outlet, no refunds (whether in whole or in part) will be issued to you and you forfeit the delivery of your cancelled order.
2. In the event that you found the meals delivered are not in good condition, you shall contact us at the number set out herein for a refund. In regard to refund mentioned herein, you agree that Bubblebee will provide a refund to you by issuing a refund voucher. You agree that the refund voucher is not a legal tender, not transferable and shall be subjected to the terms and conditions set out by Bubblebee from time to time.

F. INTELLECTUAL PROPRIETARY RIGHTS

1. Each of the Content in our Website or the Bubblebee App shall at all time owned by Bubblebee and are protected by the relevant intellectual property laws of Malaysia.
2. Bubblebee hereby grant to you a limited, non-exclusive and revocable right to access and use our Website, download and install our Bubblebee App for your personal and lawful purposes and usage.
3. Any such unauthorised reproduction, dissemination, distribution, publication, copying or modification of any of the contents in the Website and Bubblebee App will lead to a breach of these Terms and Conditions in which legal action may be taken.
4. The Website and Bubblebee App may contain content from third party(ies) and Bubblebee does not endorse any applications or sites on the internet that are linked through the Website and Mobile App, and in no event, shall be held responsible and liable for the legitimacy, accuracy, reliability and quality of these content and it is your obligation to take all precautions in all actions and interactions with such third party, conduct independent verification and comply with the third party’s terms of use.

G. LAW AND JURISDICTION

1. This Terms and Conditions is governed by and to be construed in accordance with the laws of Malaysia and you hereby agree to submit to the exclusive jurisdiction of the court in Malaysia.

H. LIMITATION ON LIABILITY AND DISCLAIMER

1. Bubblebee shall not be liable for any direct or indirect lost profits or lost business damage, special, indirect, consequential, exemplary or incidental damages, including lost data, personal injury, or property damage related to or arising out of the online services provided through the Website and/or the Bubblebee App.
2. Nothing in this section is intended to limit our liability for damages to the extent caused by our own gross negligence or intentional or unlawful misconduct. Bubblebee reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.
3. Bubblebee provides the ordering services through the Website and/or the Bubblebee App "as is" and without warranties of any kind either expressed or implied. Bubblebee disclaims all warranties of merchantability and fitness for a particular purpose. Bubblebee does not warrant or make any representation that the ordering services will be accurate, reliable, uninterrupted or error-free, that defects will be corrected, or that the ordering services are free of viruses or other harmful components. You assume total responsibility related to your use of the ordering services.
4. Bubblebee has no responsibility for Bubblebee’s failure to perform any of its obligations under these terms caused by or related to any event beyond Bubblebee’s reasonable control.

I. WAIVER

Any delay or failure on Bubblebee to enforce any right or provision in these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Bubblebee in writing.

J. AMENDMENT

We may amend these Terms and Conditions any time by posting an updated version at our Website and/or the Bubblebee App. The updated version of these Terms and Conditions shall take effect within 24 hour upon posting.
